Terms of Service

These terms govern your use of Vape Stack, the commerce platform at vapestack.co.uk that lets businesses run online stores for vaping and related products (“the Service”). By creating an account or using the Service you agree to these terms. If you are using the Service on behalf of a business, you confirm you are authorised to bind that business.

1. Who can use Vape Stack

• You must be at least 18 years old and operate a genuine business selling lawful products.
• You are responsible for ensuring your business holds any registrations required to sell nicotine or vaping products in the territories you sell to.
• During early access, accounts are created by invitation. We may decline or withdraw access at our discretion.

2. Your store and your responsibilities

• You own your store’s content: product data, images, prices, pages and customer relationships.
• You are the seller of record for everything sold through your store. Product safety, labelling, age verification duties, TRPR and MHRA notification compliance, VAT and any applicable duties are your responsibility. Vape Stack provides tooling that helps, but it does not transfer those legal obligations to us.
• You must not sell to anyone under 18, and you must not use the Service to sell anything unlawful in the buyer’s or your own jurisdiction.
• Keep your account credentials secure. You are responsible for activity under your account, and you must tell us promptly if you believe it has been compromised.

3. Acceptable use

You must not use the Service to:

• break the law or help anyone else break it;
• send spam, host malware, or attempt to gain unauthorised access to the Service or other users’ data;
• market vaping products in ways prohibited by UK advertising rules; or
• resell, copy or reverse-engineer the platform itself, other than as permitted by law.

4. Fees

The Service is free of platform fees during early access. Payment processing carries its own transaction fees, shown to you before you enable payments. Paid plans will be announced before early access ends; we will give you at least 30 days’ notice and the choice to export your data and leave before any charge applies.

5. Payments

Card payments are provided through third-party acquirers that accept vape businesses. Their own terms apply and approval is at their discretion. You must not misrepresent your business or products to a payment provider. Settlement, chargebacks and refunds follow the acquirer’s rules.

6. Your data and ours

You can export your products, customers and orders at any time. How we handle personal data is set out in our Privacy Policy. For personal data in your store (your customers), you are the data controller and Vape Stack processes it on your instructions.

7. Availability and changes

We aim to keep the Service available at all times but do not guarantee uninterrupted operation, especially during early access. We may change or improve features, and will not materially reduce the core Service you rely on without reasonable notice.

8. Termination

You can close your account at any time. We may suspend or terminate an account that breaches these terms, creates legal or security risk, or remains unpaid once paid plans apply. If we terminate without cause we will give you 30 days to export your data.

9. Liability

Nothing in these terms limits liability that cannot be limited by law. Otherwise, the Service is provided “as is”; we are not liable for indirect or consequential loss, loss of profits or loss of data, and our total liability in any 12-month period is limited to the amounts you paid us in that period (or £100 during early access, whichever is greater).

10. General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If part of these terms is found unenforceable, the rest still applies. We may update these terms; material changes will be notified by email or in the admin at least 14 days in advance.
